THROUGH SUPREME DECREE N° 3747 AND MINISTERIAL RESOLUTION N° 1373/18 OF DECEMBER 14, 2018, THE BASE LINE FOR THE PAYMENT OF THE SECOND AGUINALDO DENOMINATED "EFFORT FOR BOLIVIA" HAS BEEN ESTABLISHED. THEREFORE, IN ORDER TO INFORM THE GENERAL PUBLIC, WE HAVE PREPARED THIS SHORT ARTICLE WITH THE MOST IMPORTANT ASPECTS OF THE 2018 AGUINALDO.

Who benefits?

Workers from the public sector, public companies, and public entities subject to the General Labor Law, whose salary does not exceed Bs. 15,000.00, will benefit from the second bonus. In the private sector, the bonus payment is optional to workers whose salary is equal to or greater than Bs. 15,000.00. Therefore, the employer is not obligated to make such payment. Likewise, in order to receive this benefit, the workers must have provided services for a minimum of three (3) months without interruption, and the “obreros” for a calendar month in the present management.

Application of the 15% incentive to consume products made in Bolivia.

Fifteen percent (15%) of the total amount of the second bonus should be destined to the consumption of products made in Bolivia. The beneficiaries who receive a total salary that is equal to or less than the minimum wage (Bs 2,060.00) are exempted from this obligation.

Also, producers who want to benefit from these compulsory purchases will have to register, either digitally or in person, with the Ministry of Productive Development and Plural Economy.

Now, these compulsory purchases must be made through mobile or virtual wallets, where workers will receive 15% of their second bonus. The virtual wallet application is estimated to be available the first days of January. However, to this date it has not been established exactly how this operation will work, it is not indicated whether the employers will be retention agents of this 15%, how each mobile wallet will be registered, among others enquiries.

Therefore, the regulations that govern the payment of the 2018 bonus should be complemented in the following days.

Deadline to make the payment

The public sector must make the payment until December 31, 2018. The private sector must also pay until December 31, 2018; however, they may extend the deadline until March 29, 2019, upon a written request, made by the employer, addressed to the Ministry of Labor.
