_module_preset=\u00bbdefault\u00bb header_4_font_size=\u00bb20px\u00bb hover_enabled=\u00bb0&#8243; global_colors_info=\u00bb{}\u00bb theme_builder_area=\u00bbpost_content\u00bb sticky_enabled=\u00bb0&#8243;]El Gobierno de Bolivia aprob\u00f3 el Decreto Supremo No. 4732, de 1 de junio de 2022, mismo que tiene como objetivo el prevenir \u201ccl\u00e1usulas y practicas comerciales abusivas\u201d en los contratos de venta futura de bienes inmuebles, directamente vinculado con el sector de desarrollo inmobiliario y las preventas.<\/p>\n<p>El DS 4732 del 1 de junio de 2022, en su art\u00edculo 1 se\u00f1ala: \u201cEl presente Decreto Supremo tiene por objeto establecer disposiciones destinadas a la regulaci\u00f3n, prevenci\u00f3n de cl\u00e1usulas abusivas y pr\u00e1cticas comerciales abusivas en contratos relacionados con la venta futura, venta con reserva de propiedad u otras modalidades, de bienes inmuebles, en el marco de la Ley N\u00b0 453, de 4 de diciembre de 2013, General de los Derechos de las Usuarias y los Usuarios y de las Consumidoras y los Consumidores\u201d.<\/p>\n<p>Asimismo, el \u00e1mbito de aplicaci\u00f3n de dicho Decreto es para \u201ctodo contrato emergente de una relaci\u00f3n jur\u00eddica cuyo objeto est\u00e9 relacionado con la venta futura, venta con reserva de propiedad u otras modalidades conocidas com\u00fanmente como preventa, de un bien inmueble de cualquier tipo, incluidos lotes de terreno, viviendas, lotes de inhumaci\u00f3n, parqueos, dep\u00f3sitos, tiendas y otros bienes inmuebles ofertados bajo tales modalidades\u201d.[\/et_pb_text][\/et_pb_column][\/et_pb_row][et_pb_row _builder_version=\u00bb4.21.0&#8243; _module_preset=\u00bbdefault\u00bb custom_margin=\u00bb||10px||false|false\u00bb global_colors_info=\u00bb{}\u00bb theme_builder_area=\u00bbpost_content\u00bb]<\/p>\n<h3>REQUIREMENTS FOR CERTIFICATION<br \/>\n<\/h3>\n<p>[\/et_pb_text][et_pb_text _builder_version=\u00bb4.21.0&#8243; _module_preset=\u00bbdefault\u00bb header_4_font_size=\u00bb20px\u00bb custom_margin=\u00bb||||false|false\u00bb global_colors_info=\u00bb{}\u00bb theme_builder_area=\u00bbpost_content\u00bb]<\/p>\n<p>To get the certification, the contract must contain:<\/p>\n<ul>\n<li>Identification of the owner of the property;<\/li>\n<li>Identification of the promoter, broker, builder, or another in charge of the sale, as appropriate;<\/li>\n<li>Identification documents that prove the ownership of the property on which the project will be implemented object of the contract and\/or documents with the power of disposition of the property;<\/li>\n<li>Accreditation of the right owner of the property, &#034;folio real&#034; and the public deed of the property and the other, in which the project will be implemented, subject of the contract;<\/li>\n<li>Document with the power of disposal of the immovable property and transfer of rights, without limitation;<\/li>\n<li>Clause that permits the buyer to transfer the property or do any kind of assignment of rights or accessories;<\/li>\n<li>Duty clause of the immediate delivery of the property title to the buyer upon payment of the agreed sale price. This obligation must be set explicitly, as well as the sanctions for non-compliance;<\/li>\n<li>Express provision of non-unilateral modification of the price of sale agreed upon between the parties;<\/li>\n<li>Clauses that are not disproportionate without to the user and user, consumer or consumer.<\/li>\n<li>Date of start of the work, as appropriate;<\/li>\n<li>Date of delivery of the property subject of the contract;<\/li>\n<li>All payments made by the user or a user, consumer or consumer must perform as part of the agreed sale price, as well as payments for other concepts;<\/li>\n<li>The surface of the real estate and its technical characteristics;<\/li>\n<li>Any obligation existing on the property, including taxes;<\/li>\n<li>Plans authorized and construction permits granted by the Autonomous Government, Municipal, real estate projects;<\/li>\n<li>Document management territory approved by the Autonomous Government, Municipal, to lots;<\/li>\n<li>Clause establishing the percentage of common areas;<\/li>\n<li>Other requirements that may be requested.<\/li>\n<\/ul>\n<p>[\/et_pb_text][et_pb_text _builder_version=\u00bb4.21.0&#8243; _module_preset=\u00bbdefault\u00bb custom_margin=\u00bb||10px||false|false\u00bb global_colors_info=\u00bb{}\u00bb theme_builder_area=\u00bbpost_content\u00bb]<\/p>\n<h3>PRACTICES ABUSIVE COMMERCIAL<br \/>\n<\/h3>\n<p>[\/et_pb_text][et_pb_text _builder_version=\u00bb4.21.0&#8243; _module_preset=\u00bbdefault\u00bb global_colors_info=\u00bb{}\u00bb theme_builder_area=\u00bbpost_content\u00bb]<\/p>\n<p>The decree identifies eight types of abusive commercial practices in the framework of the Law 453:<\/p>\n<ol>\n<li>Subscribe to contracts not certified, in accordance with what is established in the Decree.<\/li>\n<li>To bid on the prospective sale, sale with reservation of ownership or other forms of pre-sale, real estate, uncredited specific faculties of the disposal on the property granted by means of a public instrument by the owner.<\/li>\n<li>Failure to meet the deadline of delivery agreed in the contract.<\/li>\n<li>Non-compliance to the technical characteristics of the property or other agreed terms and conditions; (e) The requirement of any other charge not covered in the contract.<\/li>\n<li>The breach of deals relating to the common spaces, accessories and other commitments.<\/li>\n<li>Unilateral modification of the use of the common areas offered;<\/li>\n<li>Sale of construction and other that do not have the authorization of the Self-Government of the municipality.<\/li>\n<\/ol>\n<p>[\/et_pb_text][\/et_pb_column][\/et_pb_row][\/et_pb_section]<\/p>","protected":false},"excerpt":{"rendered":"<p>BOLIVIA CREA NUEVAS OBLIGACIONES EN EL SECTOR INMOBILIARIOEl Gobierno de Bolivia aprob\u00f3 el Decreto Supremo No. 4732, de 1 de junio de 2022, mismo que tiene como objetivo el prevenir \u201ccl\u00e1usulas y practicas comerciales abusivas\u201d en los contratos de venta futura de bienes inmuebles, directamente vinculado con el sector de desarrollo inmobiliario y las preventas.
